Terms of Service

BrightEugene is a Parenting & Child Development Consulting practice operated by Eunjoo Jung in the State of Washington. By accessing this website or booking any service, you agree to the following Terms of Service, which form a binding agreement between you and BrightEugene.

1. Educational Nature of Services

All services provided by BrightEugene are educational and consultative in nature. Services are intended to provide developmental interpretation, analysis of children's behavior and interaction patterns, parenting guidance, and educational insight. BrightEugene consultations focus on interpreting children's behavior, developmental context, and family interaction dynamics in order to support informed parenting decisions.
BrightEugene provides educational consulting based on observation, research, and professional expertise in child development and education. BrightEugene does not provide medical, psychological, therapeutic, diagnostic, or clinical services. Participation in consultation does not establish a therapist-client, medical provider-patient, or clinical relationship. If medical, psychological, or therapeutic services are needed, please consult an appropriately licensed professional.

Brief Meetings are complimentary 15-minute video meetings available for exploratory conversations or brief check-ins. They do not constitute a consultation and do not include developmental analysis, recommendations, or written materials.

2. Client Responsibility

You acknowledge that all recommendations are provided for educational purposes. Implementation of any recommendations is voluntary and undertaken at your discretion as the parent or guardian. You assume full responsibility for decisions, actions, and outcomes resulting from consultation services. By submitting video materials, you warrant that you are the legal parent or guardian of the minor(s) depicted or have obtained all necessary legal consents to share such materials for analysis. BrightEugene is not responsible for consequences arising from the application, interpretation, or misapplication of information provided.

3. Booking and Payment

Full payment is required at the time of booking or purchase to confirm services. Due to the professional time reserved and analytical work performed, fees are non-refundable once services have commenced, except as expressly stated in the cancellations and rescheduling policy below.

3-Session Packages: 3-session packages are valid for 12 months from the date of purchase. Unused sessions after 12 months are forfeited and non-refundable.

Video Analysis Consultation Scheduling: For Video Analysis + Consultation, the follow-up consultation must be scheduled within 14 days of written report delivery. Failure to schedule within this window may result in forfeiture of the consultation session without refund.

Add-On Services: Video Analysis and In-Home Observation add-on services are available exclusively to families who have already purchased a Consultation. Add-ons follow the same cancellation and payment policies as the corresponding standalone services.

4. Cancellations, Rescheduling, and Refunds

All sessions require at least 48 hours notice to cancel or reschedule. Sessions canceled or rescheduled with less than 48 hours notice, or missed without notice, are non-refundable. Refund eligibility is determined by service type as follows:

  • Consultation: Non-refundable once the session has taken place.
  • Video Analysis + Consultation: Non-refundable once videos have been uploaded, as analysis may have already begun. Upload of videos constitutes commencement of the service.
  • In-Home Observation + Consultation: Non-refundable once the observation has taken place.
  • 3-Session Packages: Individual sessions within a package follow the same cancellation policy above. Unused sessions expire 12 months from the date of purchase and are non-refundable.

5. Confidentiality and Video Materials

  • Confidentiality: Information shared during consultation is treated with professional discretion except where disclosure is required by law, including situations involving the safety or welfare of a minor.
  • Video Materials: If video materials are submitted, they are reviewed solely for consultation, analysis, and developmental interpretation purposes. Videos are stored in a private, secure folder accessible only to Dr. Eunjoo Jung and are never shared with third parties.
  • Retention: Submitted videos and consultation materials may be retained to allow for future developmental comparison and longitudinal reference unless a written deletion request is received. Retention serves the purpose of tracking behavioral patterns and progress over time across multiple sessions.
  • Deletion Requests: You may request deletion of submitted videos or consultation materials at any time by contacting BrightEugene. Deletion requests will be honored within a reasonable administrative period.
  • School-Based Footage: To protect the privacy of others, only videos recorded in private home settings are accepted. School-based footage cannot be accepted or reviewed.
  • Recording of In-Home Observations: In-Home Observation sessions are recorded for analysis purposes. Consent is confirmed at the time of booking and may be withdrawn prior to the session.

6. No Guarantees

BrightEugene makes no warranties or guarantees regarding specific outcomes. Outcomes depend on individual circumstances, developmental context, and how recommendations are implemented over time.

7. Intellectual Property

All reports, written materials, and consultation documents remain the intellectual property of BrightEugene. Materials are provided for personal, non-commercial use only and may not be reproduced, distributed, or sold without written permission.

8. Limitation of Liability and Indemnification

To the fullest extent permitted by law, BrightEugene and Eunjoo Jung shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to services provided through this website or through BrightEugene consultation services. The total cumulative liability of BrightEugene for any claim shall not exceed the total fees paid by you for the specific service giving rise to the claim.

You agree to indemnify, defend, and hold harmless BrightEugene and Eunjoo Jung from and against any claims, damages, liabilities, losses, or expenses arising from your implementation of recommendations, your misuse of materials, or your breach of these Terms.

9. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Washington. Prior to initiating any legal action, you agree to provide written notice and engage in good faith efforts to resolve any dispute. Any legal action must be brought exclusively in the courts located in King County, Washington.

10. Force Majeure

BrightEugene shall not be liable for delay or failure to perform services due to circumstances beyond reasonable control, including illness, technological failure, natural disaster, or governmental action.

11. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

12. Amendments

BrightEugene reserves the right to modify these Terms at any time. Continued use of this website, checking an "I agree" box, or completing a service purchase constitutes acceptance of updated Terms and serves as your electronic signature.
